from www.dailynews.com – Los Angeles city officials moved Wednesday to adopt a county measure requiring condoms in adult films, even though the new law is being challenged in court by a leading porn producer.
In a 14-0 vote, the City Council asked a measure be drafted to direct Film LA to require a health permit assuring that condoms will be used on adult productions in order to receive a film permit from the city.
It also will ask city staff to return with a report on how violations will be determined and an enforcement plan.
The countywide Measure B received 56 percent support in November’s election. But Vivid Entertainment filed a suit in federal court challenging the law under the First Amendment right of free expression.
They also said the proposal could end up harming porn actors, who are moving out of Los Angeles to get work and no longer receiving the health care provided by the industry.
City officials say they will move forward and seek to enforce the measure until a court orders it to be delayed.
Councilman Bill Rosendahl praised the action, saying it was long needed as a way to send a message over unprotected sex.
City officials had been looking at placing a similar measure before voters, but that is being abandoned because of the success of Measure B.
