Update: Wife Found Guilty in Pig Farmer Murder; Motion for a New Trial [Additional Info]

[The following was supplied by a reader who’s been following this case since Day 1]:

Eleonora Iordanova Igova aka Nora Igova, the Bulgarian wife of Jacob Patrick Lipson aka J.P. Lipson, www.adultfyi.com/read.php?ID=34196 was retried for his murder and was found guilty of second degree murder and the special enhancement that she personally discharged a firearm in the commission of the crime.

The retrial began on 9/14/09 and closing arguments were on 9/29/09. The jury then deliberated for 2 days before reaching a verdict on 10/1/09. Her next court appearance is 11/19/09 for a motion for a new trial by the defense, other post trial motions by the defense, and sentencing by the judge.

Here is an abbreviated summary of events that were detailed during the trial and retrial:

J.P. Lipson met Eleonora Igova about 9 or 10 years ago in Colorado. He was in his early 40’s and she was in her early 20’s. They married and lived in Colorado for awhile, then moved to San Diego, CA. This was Lipson’s second marriage (he had 4 children from his first marriage). In 2007, Lipson and Igova separated, but did not divorce. He moved to a mansion in La Jolla, CA. She moved to an apartment in Beverly Hills.

In June of 2007, Igova hired a Private Investigator to locate her husband’s assets. She told the PI that she was separated from her husband and was entitled to half his assets. She thought her husband had 50 to 70 million dollars, possibly in St. Thomas in the Caribbean Islands, and/or Russia, and/or Luxemburg.

The PI suggested that she hire an attorney, but she didn’t want to do that. She signed a retainer with the PI and paid him $4,000 in cash and gave him a check for the balance of $6,000. Her check bounced, so the PI only did a preliminary database investigation on the computer and didn’t continue to try and locate any of Lipson’s assets. (After Lipson’s death, his estate found 8 million dollars of his in an account in St. Thomas.)

On 3/13/08 Igova called Lipson, telling him she wanted money. According to his housekeeper, Lipson got off the phone with her and was upset and said, “Nora’s crazy. She wants money.” So Lipson and a friend drove from La Jolla to Beverly Hills in Lipson’s Bentley.

The friend dropped Lipson off at the Peninsula hotel in Beverly Hills at 3:30 pm, where Lipson met Igova for lunch. Just after midnight, Lipson was shot 7 times (in the stomach, the chest, the shoulder, the thumb, and twice in the head) in the guest bedroom of his wife’s apartment.

Lipson was undressing and had his pants and shorts down to his knees when he was shot (either getting ready to go to sleep or to have sex with his wife). One of the neighbors in the apartment below first heard a single gunshot, then heard a body hit the floor above, then heard a male voice saying, “Nora, stop! Nora Don’t!”, then heard a rapid succession of gunshots. (Another neighbor in the apartment below heard the same things, except he only heard the male voice mumbling “Nora, Nora”.)

The neighbor below called 911 and police arrived at the front of the apartment building within minutes. Igova quietly exited the security gate in the rear of the apartment building and with her head down started walking down the alley towards her car, purse in hand.

Igova was spotted by a police officer and was detained. In her purse the police found her Bulgarian passport, her birth certificate, and $806 in cash, among other things. She also had her cell phone and the police later discovered that the phone call history had been erased on her cell phone.

The phone call history was extracted from the cell phone using special software. Also the cell phone call records were obtained from Verison. There had been a phone call at 10:21 pm from her cell phone to Lipson’s cell phone.

Then there were some calls on her cell phone either to or from Bulgaria at 11:24 pm and 11:47 pm (just minutes before the murder).

The gun that was used in the murder, a 9mm semi automatic handgun, was registered to her, and it was found in her panty drawer in her bedroom. A box of bullets (and a box of shotgun shells) was found on a shelf in her bedroom closet, and there were live bullets found all over her bedroom (on the bed, the floor, on the dresser and in the dresser). The live bullets found in her bedroom were the same as those that were fired from the murder weapon.

Igova was not put on the stand by the defense during the trial. The defense argued that the shooting was at close range, yet there wasn’t any blood on Igova’s hands, face or clothing when tested by the police. The prosecution argued that the shooting was at intermediate range and therefore blood wouldn’t necessarily have gotten on the shooter.

The defense argued that there was no gunshot residue (GSR) on Igova’s hands. The prosecution argued that her hands weren’t tested for GSR for 4 hours after the shooting, and that GSR can be washed off, rubbed off or just fall off from friction within an hour after using a firearm. The defense argued that there was DNA from 3 unknown males on the gun (there was DNA from Igova found on the gun as well as a lower amount of DNA from Lipson found on the gun).

The prosecution argued that there was no evidence of anyone else in the apartment that night, and there was no way to know when the DNA from the unknown males could have been deposited on the gun.

The defense argued that there were no fingerprints found on the gun, the magazine, or the expended bullet cartridges. The prosecution argued that fingerprints are hard to get off of a gun because a gun has rough surfaces and curves and oil on it, as well as the magazine, and bullet casings are small and any fingerprints that might be on them would be burned off when the gun is fired.

There were many other arguments from the defense as well as from the prosecution, but it gets into a lot more details.
