Augusta, Georgia- Attorneys representing an adult bookstore that took Augusta officials to federal court last year may head back to court as early as next week, after filing another motion to protect its business license.
Augusta Video X-Mart filed a third emergency motion for a preliminary injunction against the city Tuesday. The stores owners want U.S. District Chief Judge Dudley H. Bowen Jr. to prevent the city from enforcing the citys adult entertainment ordinances, which they claim is unconstitutional.
Last year, commissioners denied general manager Jimmy Cassandro a business license, saying the stores location near a busy intersection violated the citys codes.
X-Mart took the matter to U.S. District Court and was granted a temporary injunction. The federal court allowed the store to open in January, requiring the city to award X-Mart a business license.
City attorneys appealed to the U.S. Court of Appeals 11th Circuit and won. Commissioners voted 8-1 earlier this month to close down X-Mart.
