Salt Lake City- A lawmaker wants to change the law to address the problem of cell phone pornography.
Davis County prosecutors complained they didn’t have enough leeway under the law to deal with the cases of teens accused of sending nude photos on their cell phones. The proposed solution: Changing two laws so that age dictates the severity of the charge.
Bountiful Rep. Sheryl Allen [pictured] is sponsoring the proposal. She told KSL for the “Cell Phone Porn” series in June something along these lines had to be done.
“We do need to make it more clear, so they don’t have to research when these things come up, the language is very clear, they know what they’re dealing with. I think it’s a very important part of the solution,” she said.
How it works: If a suspect is over 18 years old, it’s a third-degree felony. If they are 16 or 17, it’s a class A misdemeanor. Under 16, it’s a class B misdemeanor.
