Atlantic City Casino Under Fire

Atlantic City – Borgata Hotel Casino & Spa and MGM Mirage abuse and sexually harass their female employees, known as “Borgata Babes,” under a “personal appearance” policy that includes mandatory panty checks to ensure that the women are not wearing underwear, dangerous weight restrictions, and pressure to have breast augmentation surgery, two “costumed beverage servers” claim in Atlantic County Court.

Women workers must weigh in; men needn’t. Work contracts limit them to 7 percent weight gain, punishable by suspension and firing. Plaintiffs claim the sexist policies also are unreasonably discriminatory: for example, a woman may regularly gain and lose up to 8 lbs. of water due to her menstrual cycle, potentially making her subject to firing. Plaintiffs seek punitive damages for discrimination, retaliation, constructive firing and emotional distress. Also sued are Boyd Gaming Corp., Boyd CEO Robert Boughner, Borgata’s food and beverage director Victor Tiffany.
