In February, Ventura Content, the parent company of Pink Visuals filed a $6.75 million complaint against the owners of Brazzers – Mansef, Inc., and Interhub which operate adult entertainment “tube” sites.
In the $6.75 M lawsuit there were 45 examples cited of copyright infringing content on keezmovies.com, pornhub.com, extremetube.com and tube8.com.
Except now Brazzers has filed a motion to dismiss the case calling it “fatally defective” and that Pink Visuals hasn’t shown definitive ownership regarding the copyright registrations.
Brazzers attorneys said that 23 of the videos cited in the complaint belonged to Pink Visuals which isn’t party to the suit. They also contend that the other 22 videos involved- compilations- didn’t satisfy the requirements of copyright law under civil-infringement actions.
In a story reported on by www.xbiz.com, Mansef attorneys in the 38 page motion further contend that the company doesn’t transact business in New York, where the suit was filed, and therefore isn’t subject to New York’s long-arm statute over jurisdiction. Mansef attorneys said that since the defendants are Canadian corporations, Quebec, Canada, would be an adequate alternative forum.
Pink Visual’s complaint, filed at U.S. District Court in New York, alleges that the defendants are not only aware of infringing content being uploaded to their sites, but that they “actively engage in, promote and induce this infringement.”
