Hope Miller, known professionally as internet porn model Brooke Skye, has filed a civil lawsuit against Sirius satellite radio personality Todd Clem, also known as Bubba the Love Sponge. The suit alleges that Clem coerced Miller into performing a sex act on his show against her will.
Lawsuit Details and Allegations
The civil suit was filed in Hillsborough County, Florida, and seeks a jury trial. Miller is asking for more than $15,000 in damages for each of the 10 claims made in the complaint. The allegations include assault, battery, intentional and negligent infliction of emotional distress, invasion of privacy, and negligent supervision.
According to the complaint, Miller alleges that on the June 12, 2006, episode of Clem's show, she was pressured by Bubba and his staff to be vaginally penetrated by another internet model, Melissa Harrington, also known as Melissa Midwest. The suit states that Harrington was instructed to use a large strap-on dildo on Miller. Miller claims she protested that the sex toy was too big, and that she had never engaged in this type of intercourse before. Her website, BrookeSkye.com, does not feature hardcore sex.
The lawsuit further alleges that despite Miller's repeated objections, Clem continued to prod and pressure Harrington to "go deeper." Miller indicated her discomfort by shaking her head "no" and verbally communicating her unease to Clem and the studio staff. The complaint states that Clem allegedly threatened Miller, saying he would "Kick your ass out of my studio and tell everybody not to visit the website" if she did not comply. Miller's attorney, Steve Silton, stated that Clem also told Miller he was going to make her do something she did not want to do and gave her alcohol despite her not being 21 years old.
In addition to Clem and Harrington, the lawsuit also names Harrington’s webmaster, Adam Silverman, known as Biggy, and Bubba the Love Sponge Show staff, as well as Sirius Satellite Radio.
Defense Arguments and Court Proceedings
On July 26, 2007, a circuit judge refused to dismiss the lawsuit. Robert Santa Lucia, Clem's attorney, argued that Miller was aware she was coming to the radio studio to engage in sex acts and had signed releases allowing the dissemination of a video of the event. Santa Lucia contended that the lawsuit was not legitimate and was an attempt by Miller to promote her website. He also argued that Miller's claim of being forced due to threats of not promoting her website was not a valid defense.
However, Miller's attorney, Steve Silton, countered Santa Lucia's arguments, stating that the case "is about power and the abuse of power by an individual who puts himself in control." Silton reiterated the allegations that Clem threatened Miller's career and her website promotion if she did not participate.
A SiriusBuzz article from October 6, 2006, reported that Bubba was not in the studio that day. The article's author, Charles LaRocca, stated that he listened to the show in question and did not hear anyone being forced. LaRocca also noted that Brooke Skye had been on the show twice before and suggested she was aware of the show's nature. He questioned the validity of Miller's claim that she was forced due to threats regarding website promotion.
