Bryan Kocis Slaying brings 6 warrants

WILKES-BARRE, Pa – A spokeswoman for the Luzerne County District Attorney’s Office said three search warrant affidavits that partially describe the gruesome murder of gay porn producer Bryan Charles Kocis were never meant to be sealed.

Carol Crane said there have been six search warrants filed. Three have been sealed from public view.

Three were filed on Friday in the Luzerne County Clerk of Courts Office for Kocis’ electronic communications, including telephone, cell phone and e-mails between Jan. 18 and Jan. 25. A request was never made to seal those warrants, Crane said.

On Monday, investigators through Assistant District Attorney Tim Doherty filed three search warrants that were ordered sealed by Judge Peter Paul Olszewski Jr, Crane said.

The Times Leader and other media obtained the three unsealed search warrants on Monday.

Crane said it was initially believed on Monday that the sealed search warrants were released to the media.

Two local television news stations reported that the search warrants filed on Friday were mistakenly released.

Clerk of Courts Robert Reilly said a request was never made to seal the three search warrant affidavits that were filed on Friday. Doherty and a state criminal investigator did request to seal search warrant affidavits that were filed on Monday, Reilly said.

Reilly said if search warrants aren’t sealed, they are available for public inspection.

Under state law, prosecutors can request a judge to seal search warrant affidavits for 60 days.

State police Lt. Frank Hackin, criminal unit supervisor at Troop P, Wyoming, had no comment on the release of the search warrants.

The unsealed search warrant affidavits say that Kocis, 44, was stabbed 28 times with no defensive wounds on his hands and arms. Kocis also suffered a “slash type wound” to his neck that severed arteries and veins.

Investigators said they recovered a folding-style knife inside the home, but the affidavit didn’t say if it was the murder weapon.

Kocis was found by firefighters who responded to a fire at his home at 60 Midland Drive, Dallas Township, shortly after 8:30 p.m. last Wednesday.

Luzerne County Coroner Dr. John Consalvo said Kocis was dead before the fire because there were no carbon monoxide levels in the body or burnt particles in his airway and lungs.

Hackin previously said he believed the fire was intentionally set to cover up the murder.

State police fire marshal Trooper Ronald Jarocha determined the fire was arson, and the origin of the fire was a couch where Kocis’ body was found.

Investigators believe Kocis may have had a personal association with the suspect, and may have been in contact with the suspect in the days before his death, according to the search warrant affidavits.

Firefighters encountered an open exterior door that had no signs it was forced open.

A witness said a white or silver colored sport utility vehicle was seen leaving Kocis’ driveway at about the same time smoke alarms were heard sounding in the home.

Several people have been questioned, including a person in Germany and a person in Britain, said a law enforcement source close to the investigation.

Kocis, the owner of Cobra Video, produced and directed gay pornographic movies. He operated his business from his home.

Trooper Martin Connor said Tuesday that progress is being made in the investigation.
