from www.nbcsandiego.com – The conviction of a San Diego City Councilman is upheld, as was the acquittal of a second, the Ninth Circuit Court of Appeals ruled Tuesday.
After Ralph Inzunza [pictured] and Tony Zucchet were convicted in 2005 on corruption charges, both men moved for judgments of acquittal, but only Zucchet was granted an acquittal on most of the counts he was convicted of — he was, though, granted a new trial on the remaining conspiracy and honest services fraud counts. Inzunza was sentenced to 21 months in prison.
Inzunza, who has been out on bail pending his appeal, isn’t going to jail yet, however. The Supreme Court will rule on a similar case that is pending in Alaska, and once that decision is final, both “Inzunza’s lawyers and the government may request an en banc hearing, in which they ask for a review by the full 9th Circuit. Failing that, both sides may seek Supreme Court review, which is rarely granted,” reported the voiceofsandiego.org.
The councilman were accused of taking money from strip club owner Michael Galardi in exchange for efforts to overturn the so-called “no touch” rule in San Diego.
