Former Cuyahoga County Recorder Gets 15 Months on Obscenity Charge

Ohio- Former Cuyahoga County Recorder Patrick J. O’Malley surrendered to U.S. Marshals in an Akron courtroom Friday.

Judge David Dowd ordered O’Malley into immediate custody to begin serving a 15-month prison sentence.

O’Malley pled guilty to one count of obscenity last May.

During the four hour hearing, O’Malley attempted to discredit his ex-wife Vicky Allen.

Locked in a bitter custody dispute, Allen informed the FBI in 2004 that O’Malley had obscenity on his home computers.

Two computers and a several computer discs turned over by Allen contained images of child pornography.

The U.S. Attorney’s Office did not pursue child pornography charges due to chain of custody concerns.

Instead, federal prosecutors agreed to the one count obscenity plea related to material found on a computer seized in a subsequent raid on O’Malley’s home.

The evidence included downloaded images of bestiality and fictional erotica involving the rape of children.

Not testifying under oath, O’Malley told the court his ex-wife had “participated in bestiality, incest, and prostitution prior to [their] marriage.” He also claimed Allen had introduced him to pornography and “alternative lifestyles [he] never even knew existed.”

After the hearing, Allen declined to comment on her ex-husband’s allegations.

O’Malley expressed remorse and humiliation.

He broke down in tears as he attempted to apologize to his five children.

His attorney Ian Friedman argued for probation while the government pushed for a five-year prison term.

Both positions would have involved a variance from federal sentencing guidelines, which call for 12 to 18 months of incarceration.
