Briefly, Sakas’ New Bern, North Carolina store was raided in January because he had stocked dildos along with DVD’s [state law says you have to stock one or the other but it’s never been strictly enforced] On top of that, the cops still have all the inventory they confiscated in the raid. The Christian Coalition was behind the raid and Sakas’ dealings, or lack of, with the intractable police chief Frank Palombo is keeping this case from having any resolution.
Now it appears a trial is set for June 11th.
In the meantime, Sakas was attempting to cut a deal with the city that would settle the case. And the city expressed agreement in doing so. But Palombo has been the stumbling block by not signing off on the case. Rather, he feels that he was justified and warranted in his actions against Sakas and was following the laws of the state.
Another way the case could have been dropped was if Palombo were to say that after extensive investigation, violations were found which had been resolved. However Palombo didn’t want to agree to that, although Sakas feels there were never any violations to begin with. Palombo has also stated that he wants Sakas and his store to get out of town.
Sakas, who isn’t leaving if he can help it, has been arguing all along that according to state regulations, he shouldn’t be considered an adult establishment. In addition, Sakas had been assured by Palombo that he would receive an inventory of items confiscated from his store. But that hasn’t happened and Sakas feels the city cops have basically helped themselves to porn, courtesy of his store.
To that extent, Sakas feels confident he won’t get his inventory back.
Sakas also concedes that Palombo is a very popular police chief and politically well connected at the same time. But that doesn’t answer the question why this case is being pursued.
“You got drugs, rapes and robberies and you’re going to worry about a third class misdemeanor?” Sakas asks. “It would be different if there were other issues involved but they’re not.”
According to Sakas, representatives of the Christian Coalition visited his store last week and complained that the novelties were probably from a foreign country, likely not FDA approved and didn’t meet the standards for rubber.
“Is this a joke?” Sakas asks. “I’m laughing to say this.”
