Indianapolis Judge Blocks Adult Bookstore Ordinance

A federal judge in Indianapolis has blocked a new city ordinance that places tighter restrictions on adult bookstores.

Judge Sarah Evans Barker says she has reservations about the constitutionality of the ordinance. City attorney Scott Chinn says the order means the city can’t enforce the ordinance.

The ordinance sets new rules for adult book-and-video-stores. It limits their hours and requires them to be closed on Sundays. It also requires them to remove doors from viewing booths.

The city-county council passed the ordinance unanimously last month at the urging of Mayor Bart Peterson. Annex books, which operates four adult book and video stores in Indianapolis, sought the restraining order.

Chinn says the Indianapolis law is similar to ordinances in other cities that have been upheld by the courts.
