Georgia- The owner of an adult video chain on Thursday filed suit against Fulton County demanding that the county give him a business license.
The suit, filed in federal court, claims the county is not following its own ordinance in denying John Cornetta a license for a new store in Johns Creek. The suit says the denial is intended, at least in part, to chill Cornetta’s free speech.
Cornetta planned to open a Love Shack retail store with less than 25 percent of his inventory being explicit sexual videos and publications. More than 25 percent would trigger the county’s adult entertainment ordinance, which has carries enforcement provisions and zoning issues.
Fulton County officials have told Cornetta he needs to get an adult entertainment license anyway, a move the lawsuit called “arbitrary.”
The store would be less than a throw from home plate to second base from a subdivision, and slightly less distance to a dance studio that caters to children.
