LOS ANGELES — A judge Tuesday cited a full calendar in delaying until August a hearing on whether to revoke bail for an Orange County assistant sheriff’s son arrested for statutory rape while awaiting retrial in a gang- rape case.
Orange County Superior Court Judge Francisco Briseno said 19-year-old Gregory Haidl is due in his courtroom on Aug. 6 in connection with retrial on the gang-rape charges.
He set a hearing on the bail matter — which could include witnesses — for Aug. 9.
Deputy District Attorney Dan Hess — arguing that his “primary focus is ensuring the safety of the community” — had asked for an earlier date.
But Briseno, who is scheduled to begin a murder trial tomorrow in a 1991 slaying, told lawyers he had no “down time” until August for the Haidl case.
He said that some of his other cases also “constitute a danger to the community.”
Haidl has been free on $100,000 bail in connection with charges that he and Kyle Nachreiner and Keith Spann, both 19, of Rancho Cucamonga raped and penetrated “Jane Doe” with a pool cue, Snapple bottle and other objects on July 6, 2002 at the home of Haidl’s father, Don, a successful businessman and non-paid assistant sheriff who was not home at the time.
After jurors deadlocked on all counts, Haidl allegedly had sex with a 16- year-old girl on July 14. Prosecutors filed a new misdemeanor charge of statutory rape last week.
Referring to the elder Haidl’s wealth that he accumulated as a successful businessman, Susan Kang Schroeder of the Orange County District Attorney’s Office said the father could post any bail increase, hence the need for bail revocation.
Hess also wants Briseno to order Haidl to hand over his passport.
Defense attorney Pete Scalisi said he will oppose bail revocation and any increase in bail in connection with the new allegations.
“I would characterize them as two teenagers who were dating like any other couple,” Scalisi told reporters outside the courtroom. “But because he’s Greg Haidl, he’s been the subject of intense media scrutiny and prosecutorial” zeal.
