Porn Valley- As we reported first awhile back, former AVN employee Judy Sweeney is suing AVN. Sweeney was fired after disclosing her pregnancy and after complaining to Human Resources that she was the subject of hostile treatment from her boss Darren Roberts, nicknamed Dagwood and the weasel throughout the industry. This, after Sweeney reported the pregnancy. Sweeney, an African American, is petitioning for a jury trial. Roberts is identified in the lawsuit as the owner of AVN.
Sweeney who is petitioning for a jury trial was terminated by AVN, May, 2004. At the time of Sweeney’s employment she was told that she did not have to work over time- a factor that was important to Sweeney because she had a young daughter who was in school and Sweeney would have to pick her up. That same year Sweeney learned that she was pregnant with a second child. As soon as she told Roberts, he allegedly made comments that he bet she wouldn’t come back to work. Roberts then allegedly began making Sweeney work overtime hours and his disposition to her became cool and hostile, according to her lawsuit. She complained to Human Resources. But Robert’s disposition towards her did not improve, Sweeney contends. She also had to take time off for doctor’s appointments and there were instances when she’d be ill. Within a few days of her stating that she had to take some leave for a medical-related pregnancy condition, Sweeney was fired.
Sweeney’s lawsuit cites three government codes- 12940, 12945 and 12926 that refrain an employer from discriminating against an employee on the basis of pregnancy. Sweeney’s suit also cites gender and race being factors in her being subject to “intentional” discrimination. Roberts’ and AVN’s conduct is described as “willful, despicable, knowing and intentional.” Sweeney is suing for compensatory damages to include lost wages, sick pay, vacation pay and employment benefits. She’s also suing for general, mental and emotional distress; as well as punitive damages to include reinstatement, back pay, benefits and interest. Sweeney’s also suing for litigation costs and attorney’s fees.
