Kansas- The 10th circuit has vacated a preliminary injunction that restrained Kansas from requiring doctors, teachers and other to report any instance of a child under the age of 16 engaging in sexual activity. Aid for Women and others claimed the 2003 Kansas law violates the minors’ right to privacy.

But J. Ebel finds that plaintiffs failed to show a substantial likelihood of success on the merits because Kansas law criminalizes all sexual conduct with minors under 16, thus the minors have no right to privacy in their illegal sexually activity. Thus, the 10th circuit vacates a preliminary injunction against the reporting statute.
