The city of New Bern, in a counter move, is now dicking with Sakas. It wants to move the lawsuit to a federal jurisdiction.
“Scott C. Hart who’s the lawyer for the insurance carrier for the city is now involved and has removed it from state court to federal court,” reports Sakas.
Ironically, Sakas had not been aware of this development and only found out about it when he received a phone call from The News & Observer, probably the most prominent newspaper in the state.
“One of their legal reporters contacted me wanting to do a front page story on all this,” explains Sakas. “They can’t believe after reading these documents how in the world a police chief [Frank Palombo] or even a city has allowed this to happen.”
“And we found out that [district judge] Walter Mills is the only judge out of eight in the whole district who has the balls to stand up to The Christian Coalition to hear it,” Sakas goes on to say.
The criminal case against Sakas stems from two store raids and has nothing to do with the lawsuit Sakas had filed.
There has been a number of postponements of that criminal trial, but they’re the city’s doing, not Sakas’.
“This has been going on over a year because no judge was willing to take on the Coalition,” says Sakas. “Is that ludicrous or what?”
“They’ve got one judge willing to hear the case. And my understanding is that the city DA may have to appeal if he loses because it would involve with the Christian Coalition!”
“Then we may have to go to another court. Can you believe this?”
With all the tactical frustrations thrown in the path of the Sakas case, others might have thrown in the towel by now; but Sakas says it’s too late in the ball game for him to think like that.
“I’d be curious to see what will happen if the News & Observer does a front page story,” says Sakas. “I don’t think it bodes well for them [the city of New Bern].”
