In February, Ventura Content, the parent company of Pink Visuals filed a $6.75 million complaint against the owners of Brazzers – Mansef, Inc., and Interhub which operate adult entertainment “tube” sites.
In the $6.75 M lawsuit there were 45 examples cited of copyright infringing content on keezmovies.com, pornhub.com, extremetube.com and tube8.com.
Brazzers then filed a motion to dismiss the case calling it “fatally defective” and that Pink Visuals hasn’t shown definitive ownership regarding the copyright registrations.
In the turnabout is fair play genre, Mansef, Inc. and Froytal Services Limited, a Cyprus corporation that owns the Brazzers websites, have now filed a lawsuit in U.S. District Court in Los Angeles against Ventura Content [Pink Visual] and Denali Holdings.
The suit alleges- guess what- federal trademark infringement, false designation of origin, common law trademark infringement and unfair business practices.
According to a story reported on www.avn.com, the complaint also alleges that Ventura Content is and was an Aruban corporate entity, with its principal places of business in Van Nuys, Calif., and Tucson, Ariz., and is the owner/operator of PinkVisual.com and iPinkVisual.com.
Denali Holdings is alleged to be a California corporation with its principal place of business in La Jolla.
The complaint goes on to allege that Pink Visual in an effort to drive traffic to its websites purchased as Google AdWords keywords containing or constituting the Brazzers mark, including, but not limited to: ‘Brazzers,’ ‘Brazzers Mobile,’ and ‘Brazzers Vids’ (collectively ‘the Keywords’).”
Claiming that their goodwill, reputation and business has been irreparably damaged as a result of the alleged acts, Mansef is asking the court to enjoin the defendants from any further such activity, and also to pay triple compensatory damages sustained as a result of their alleged actions. Punitive damages also are being requested, in addition to attorney’s fees.
