NY- A 40-year-old woman on her first date with a man she met on Match.com allegedly was raped by her companion after getting drunk at a Syosett bar and going home with him, cops said yesterday.

Daniel Bile, 39, of Redpole Lane, was being held yesterday in lieu of $40,000 bail after being arraigned in District Court in Hempstead on one count of first-degree rape.

A lawyer for Bile, Marc Gann, said his client, a divorced father of a young girl, is innocent, contending, “I’m confident there was no rape here.”

According to investigators, Bile forcibly had sex with his date inside his second-floor apartment early Wednesday morning despite being told by the victim to stop.

The woman began communicating with Bile on the Internet dating service last Saturday and, after their online chats led to telephone chats, the two decided to meet for drinks at the Inn Between bar.

Police said after rendezvousing around 11:30 p.m. Tuesday, the woman consumed several mixed drinks and shots in a short period of time.

“There came a point where she felt she was intoxicated and didn’t think it would be safe for her to drive,” Nassau police spokesman, Lt. Kevin Smith said. “She then agrees to go to his home. The agreement was that he was going to drive and they would end up at his home.”

Smith said once they got upstairs, Bile “immediately gets romantic with her,” but she complained of not feeling well and lay down on his couch.

“He then lays down on top of her,” Smith said. “She tells him she is not interested. He then starts taking her clothes off.”

“She’s conscious,” Smith added, “but she is too intoxicated to rebuff him physically. But she is telling him she does not want to have sex with him.”

After sexually assaulting the woman, Bile told her he was going out to buy some cocaine, eventually giving the woman an opportunity to call police, investigators said.

Cops later arrested Bile, a home heating oil technician for Meenan Oil, when he returned home around 5:43 a.m. Wednesday.

The victim was taken to North Shore University Hospital for treatment and a rape kit exam.
