from www.patch.com – A city working group recommended Wednesday that the City Council and mayor begin the process of hiring a “medical professional” to conduct periodic inspections of adult film sets to enforce a requirement that actors utilize condoms.

But the group also recommended that the city allow Los Angeles County to take over enforcement of the requirement — but only if county voters in November approve the “Safer Sex in the Adult Film Industry” initiative. That initiative would require adult film producers to apply for a permit from the county Department of Public Health to shoot sex scenes.

The City Council voted in January to require the use of condoms on the sets of porn shoots, but a working group has been meeting for the past seven months to decide on ways to enforce the mandate.

City Administrative Officer Miguel Santana, a member of the working group, Wednesday released the panel’s recommendations in a 47-page report. The group also included members of the Personnel Department, the City Attorney’s Office, the Police Department, the California Division of Occupational Safety and Health, the Cal-OSHA Standards Board and relevant stakeholders.

The group recommended turning enforcement of the condom requirement entirely over to the county’s Public Health permit system if county voters approve the initiative in November. Such a move would also require the City Council to put a measure on an upcoming March or June citywide election ballot allowing the county’s permit system to become the enforcement mechanism for the city.

In the meantime, the group supported amending the Film L.A. permits that all on-location productions are required to obtain. The group recommended adding a box on the film permits for productions to mark if filming includes “Activities Carrying Risk of Transmission of Blood or Infectious Materials.”

The working group also said the city should move forward with hiring a “licensed medical professional” to conduct periodic inspections of adult film shoots. Santana recommended the mayor and City Council make a formal request that his office begin the bid-solicitation process and bring the request for proposals back to the council within 90 days.

The report also recommends Santana draw up a fee structure in the next 90 days for adult film producers to cover the cost of the extra inspections.

The cost of hiring medical inspectors and putting the issue before voters next year is not yet known, the report stated.
