SAN RAFAEL — from www.sfgate.com – Pornography mogul James Mitchell stunned a Marin County courtroom Tuesday when he testified in his murder trial that not only did he not kill his girlfriend, but on the day of her death he fought off two attackers at her house and never saw her bloodied body on the grass nearby.
The 29-year-old defendant said he had just arrived at the Novato home of Danielle Keller on July 12, 2009, to celebrate the first birthday of their daughter, Samantha, when he heard Keller scream for help.
“I jogged around the side yard, and I was immediately engaged with a man in a white shirt,” Mitchell calmly testified, chin resting on one hand. A second man in a black shirt then came up and hit him in the back with a baseball bat, he said.
Somehow in the tussle, he said, the man in the white shirt wound up running away with a screaming Samantha. Mitchell chased the man down near the house, took the child and fled in his car, he testified.
Asked why he didn’t call the police, go back to the house or try to check on Keller, Mitchell shrugged and said he was afraid of the police because he had previously clashed with them for violating a restraining order Keller had lodged against him.
“I’m not a murderer,” Mitchell said.
His testimony was the first time anyone in the audience – which included investigators and family and friends of Keller – had heard the story of the attack, they said.
Porn empire family
Mitchell, son of the late Mitchell Brothers porn empire co-founder Jim Mitchell, is on trial for allegedly clubbing the 29-year-old Keller to death and kidnapping their baby. He was arrested the day of the killing in Citrus Heights (Sacramento County). The girl was unharmed.
Mitchell’s father founded the Mitchell Brothers O’Farrell Theater in 1969 with his brother, Artie Mitchell, and they produced a string of pioneering porn movies including “Behind the Green Door.” Jim shot Artie to death in 1991, served three years in prison and died of a heart attack in 2007.
James Mitchell, who lives in Pittsburg, inherited his father’s and uncle’s multimillion-dollar porn empire with other relatives, and until his arrest was director of film operations.
His trial began in San Rafael on June 21. Until Tuesday, testimony centered on neighbors saying they had seen the portly, balding Mitchell beat Keller with a metal baseball bat as she lay face down in her yard, and his own family members saying he had planned to flee to Mexico with his baby.
Domestic violence
The jury also heard testimony from police and, on Tuesday, from Mitchell himself, that he had slapped and pushed Keller so many times in their two-year relationship that he was convicted of domestic violence in 2008 and served with a restraining order that was still in place the day of her death.
Keller’s mother, Claudia Stevens, said Mitchell was making up the account of the two men.
“He’s nuts, just a vicious take-what-you-can kind of guy,” she said. “He killed my daughter.”
Stevens testified earlier Tuesday that her daughter had not owned a bat, supporting prosecution contentions that Mitchell had brought the bat to Keller’s house to kill her. As she spoke, she tightly clutched a small silver purse containing her daughter’s ashes.
Mitchell takes stand
Later, when Mitchell took the stand in a black suit and silver tie and began rolling out his story of fighting the two men, Stevens’ eyes filled with tears and she pressed the silver purse to her lips. None of Mitchell’s family or friends attended his testimony.
Asked why the story of the two men hadn’t emerged earlier, defense attorney Stuart Hanlon said, “Because we hadn’t had a trial before.”
