DALE, Ind. — County officials are trying to temporarily shut down a 24-hour adult bookstore selling pornography and offering peep booths in southern Indiana.
The Spencer County Planning Commission and Board of Zoning Appeals on Tuesday unanimously approved a plan to seek an emergency injunction to close the Adult Plaza about 35 miles northeast of Evansville until its owners comply with county ordinances.
The store used to be a truck stop along U.S. 231.
The plan commission was going to tell the court that the store’s owners failed to file for the proper permits and have violated a zoning ordinance that passed last week to restrict adult businesses.
Plan commission attorney John Wetherill said he was going to file the injunction Wednesday morning in Spencer Circuit Court, but he cautioned that because of the Thanksgiving holiday, it might take time to process.
“We acted as quickly as we heard there was a concern,” Al Logsdon, a member of the commission, said of last week’s ordinance.
The property was sold Sept. 16 to Allen Properties, of Louisville, Ky. The Associated Press left telephone messages with the company seeking comment on Wednesday.
The new ordinance mandates that no one younger than 21 be permitted inside. Business hours are restricted and adult-oriented businesses cannot operate within 1,000 feet of a church, school, daycare or residence.
Commission attorney John Wetherill said if the injunction is approved by a judge, the owners of the Adult Plaza would have to apply for permits and comply with the new ordinance.
