Wisconsin – The Plan Commission voted last week to create a panel to figure out how to deal with zoning porn shops in Madison.

The commission unanimously approved referring a porn zoning plan by Ald. Tim Bruer, [pictured left] 14th District, to a future commission that will be created by the chair of the Plan Commission.

Bruer spoke out for the referral of his plan at the meeting. According to Bruer, after doing some research, he discovered that his ordinance — which would both crack down on the disguising of porn shops as “gift shops” and allow them in more places in Madison — would not provide enough alternative places for porn shops to keep them from suing the city for driving them out of town.

Bruer’s ordinance would have increased enforcement of a law defining stores displaying pornography on more than a certain percentage of their floor space, keeping them from ducking under the cover of “gift shops” to find more locations, he said.

“If it looks like a duck, walks like a duck, and quacks like a duck, it’s a duck, and this is a porn duck,” Bruer said.

But to keep the city from being sued for driving out the shops, it would also have allowed major highways to serve as “buffer zones” from schools and churches.

However, Bruer said, he realized that this would not create enough new locations to stave off First Amendment-based lawsuits, and he decided to ask the Plan Commission to find a new way to deal with it.
