Phoenix- The initial court appearance for a former Buckeye town manager accused of public sexual indecency in a Phoenix adult shop has been delayed until Dec. 28.
Meanwhile, more details have emerged in the Nov. 1 incident that led to Dave Wilcox’s legal troubles.
Wilcox, 60, initiated contact with another man that night when they were caught engaged in sexual activity, according to a Phoenix police report.
The report shows Wilcox and David Duran, 34, of Phoenix told an undercover officer that Wilcox had entered the viewing booth where Duran was watching a pornographic video at the Adult Shoppe, near 24th and Jefferson streets.
According to the report, the officer was making a sweep of the store when he spotted Wilcox and Duran in a video-viewing booth. The report shows the officer stepped inside the booth to find the two men engaged in a sex act.
Phoenix code allows only one person per booth.
“I’m just scraping the bottom of the barrel in my life right now,” Wilcox told the officer, the report states, noting that Wilcox said he was on his way to the airport to pick up his daughter that evening and had not intended to visit the store.
Wilcox, who is married, and Duran were cited and released at the scene on suspicion of public sexual indecency, a misdemeanor. Wilcox’s attorney John Tatz said Friday that Wilcox’s court appearance was pushed back because the defense is “still discussing the case.”
In October, Wilcox signed a separation agreement with Buckeye, nine months into a two-year contract.
The Town Council kept him on the payroll as a consultant until Dec. 31 but he was placed on paid leave after the arrest.
