Kansas- A settlement has been reached between Abilene Retail #30 and the Dickinson County Commission.
The agreement allows the business, known as the Lions Den, 2349 Fair Road, Abilene, to remain at their present location, but they cannot expand their building, which is located at the 272 exit of Interstate 70.
Under the agreement, Lions Den would be allowed to restore or rebuild their structure if it is damaged or destroyed. It cannot own, operate or manage another sexually oriented business or business licensed by Kansas to sell alcohol within 1,200 feet of its existing business and structure. The papers were recently filed on the agreement were filed in the Tenth Circuit Court of Appeals.
Within 30 days of signing the agreement, the Dickinson County Commission agrees to adopt an ordinance that “grandfathers” the business at its present location and condition from application of the location and distance restrictions of “adult bookstore or adult video store” or “any sexual device shop” that existed or was doing business in Dickinson County prior to Dec. 13, 2004.
“I’m pleased with the settlement, that it will not drag out any longer,” commission chairwoman Sheila Biggs said, adding that the next step was a court case.
Commissioners, meeting at today, had an agenda item to consider action on sexually oriented businesses.
