Winnipeg – A pair of courthouse sheriffs caught on video canoodling with a local porn performer have won their fight to remove the steamy tryst from the Internet — at least for now.
Jacqueline Burgoyne and Rick Gordon claim they were drunk when they signed a waiver allowing the racy rendezvous to be recorded and did not know it would be posted on the Internet.
Yesterday, the porn performer/escort Oshean [pictured] and her husband Johannes de St. Claire de Guise agreed to remove the video and all still pictures from Oshean’s website, pending the outcome of a hearing next month.
Neither party appeared for a hearing yesterday before Justice Shawn Greenberg.
“We are doing this to show good faith,” said Oshean’s lawyer David Guttman outside court.
Guttman said his clients chose to remove the video voluntarily rather than be ordered to do so by the court.
“In no way are we admitting their allegations are accurate or that the remedies they are seeking are appropriate.”
Guttman said his clients will be hotly contesting Burgoyne and Gordon’s allegations in court.
“I think it is an issue for (my clients) to be allowed to display material they have produced,” he said.
Burgoyne and Gordon were suspended by Manitoba Justice on Dec. 28 after word spread of the online hanky-panky, which the website states was filmed here during Grey Cup weekend. The pair were reinstated Jan. 8 and immediately went on stress leave.
According to a statement of claim filed last month, the officers met the porn performer and her husband at the Desire nightclub, where Oshean broached the idea of going back to her place and recording a sex video with her.
After arriving at the couple’s Garry Street apartment, the officers were served drinks and asked to sign a document indicating they were both over 18 and that they were consenting to the recording of the activities to follow.
What exactly is contained in the waiver is unclear. According to the statement of claim, the officers say they were not provided a copy of the document. A statement of defence has not yet been filed.
All allegations have yet to be proven in court.
