SIOUX CITY, Iowa — Sioux City has avoided a 50-thousand dollar sanction in a lawsuit filed by an adult business.
A federal judge says the sanction is warranted, but he won’t impose it because the city has changed its policy covering retention of such records.
The judge’s ruling deals with the city destroying records from closed meetings while defending itself in a lawsuit filed by Doctor John’s Lingerie Boutique.
Earlier this month, the city agreed to pay 220-thousand dollars to the business’ owner, John Haltom, to settle the lawsuit. The city also paid nearly 370-thousand dollars in legal bills.
In his lawsuit, Haltom claimed the city’s zoning ordinances dealing with adult entertainment were too restrictive and violated his constitutional rights.
