DOTHAN, Ala. — from www2.dothaneagle.com – A Florida man charged with violating the state’s anti-obscenity act at a Houston County nightclub could have his felony charge dropped.
Attorney Matt Lamere said his client, Michael Gene Cox, was accepted into the Houston County pre-trial diversion program. Court records indicate Houston County Sheriff’s investigators arrested Cox, 40, of Lynn Haven, Fla., on Nov. 14, 2009, and charged him with the class C felony crime of violating the state’s anti-obscenity act.
Sheriff’s officials released information earlier that deputies charged Cox with running a business that allowed too much nudity. An earlier Dothan Eagle report indicated deputies charged Cox with doing business at Secrets Gentleman’s Club, which is located in the 14000 block of U.S. 231 South near Madrid.
Lamere said as part of pre-trial diversion program requirements, if his client follows certain conditions and stays out of trouble for 12 to 24 months the felony charge will be dropped. Lamere said some of the conditions include his client completing some community service.
If convicted of the charge, Cox faced one to 10 years in prison for the Class C felony crime.
Deputies also arrested a reported dancer at the nightclub on same day as the Cox arrest. Court records indicate Cynthia Best, 34, of Cottondale, Fla., was also accepted into the Houston County pre-trial diversion program. She was accepted into the program in September 2010, for a felony unlawful possession of a controlled substance charge.
