Two more porn sites attach themselves to Pace High School issue

Pace, Florida – from www.srpressgazette.com – First it was Pace High School and now two more web domains haves popped up related to the defense fund established for Pace Principal Frank Lay and Athletic Director Robert Freeman.

Two new adult sites were opened by Shen Shagua of Shanghai back on Aug. 13 of this year, with both domains set to expire in 2010.

The two new sites are www.layfreeman.com and www.layfreemandefence.com, which are rather alarming to Robert Smith, who established the domain www.layfreemandefense.com.

“It shows you the state our nation is in,” said Smith the night before Lay and Freeman were to appear in U.S. District Court in Pensacola. “These are the evils of darkness coming to light.

“This is a discredit to what we are trying to do and someone who is trying to capitalize for evil.”

Attempts to contact Shagua via e-mail were not returned by press time.

The original website started on Aug. 3 has been used to help raise nearly $70,000 as of Sept. 15 to help with the legal expenses of Frank Lay and Robert Freeman who needed to come up with a retainer in obtaining a lawyer in a effort to deal with a criminal contempt charge brought against them by Judge Casey Rogers.

Ironically the first website in question, PaceHighSchool.com came to light at the end of August.

Smith feels that most of this has to do with the publicity Pace High School, Frank Lay, and Robert Freeman have receive nationally due to their legal issues with the ACLU.

There are similar named schools in Miami, Brownsville, Texas, Cincinnati, New York, Tyler, Texas, Tucson, Ariz., and Wapato, Wash., these might start becoming more than just isolated.

Attorney General Bill McCollum’s office has not received any complaints on PaceHighSchool.com and they are unable to take any action since they have not violated any cyber crime issues, which the office handles.

The FDLE are aware of the three website and are checking to see if they have any jurisdiction over the matters.

“The two things you can do,” says Susan Wade, Director of Public Relations for Network Solutions (one of several firms that license online names), “is file a petition with ICANN (Internet Corporation for Assigned Names and Numbers) or take the cyber squatter to court. It depends on who it is and where they are located.”

PaceHighSchool.com was filed as a domain name on Oct. 9, 2002 by Cheapies.com based out of Toronto, Ontario.

Cheapies.com is a Canadian version of the popular GoDaddy.com

The website pacehighschool.com domain is set to expire on Oct. 9, 2009 (if not renewed) and was last updated on June 16, 2009 just before midnight.

Wade pointed out that these things do happen.

Wade says it isn’t uncommon for firms looking to make money to secure names that might soon be needed. “There are ways people can file a possible breach or abuse of a domain register,” says Wade. “We just don’t have a way to determine what they will do when they register a domain and we don’t police the content on domains.”

Pace High School or any other high school involving the use of Pace could take the matter further to the ICANN if their name is trademarked according to Wade.

“If the high school name is trademarked then they can file a uniformed dispute resolution process (UDRP) with ICANN for going against their trademark,” said Wade. “That is about the only way a high school can protect itself in a case like this.”

When asked if the site in question could be getting some traffic due to mistypes, Lay said anything is possible.

“I am sure it has happened,” said Lay. “The only thing we can do is take it off of web access here and on the county servers as well.”

An ICANN representative who answered the phone at their California offices stated the only thing that can be done is to take these people to court.

Calls to Verisign’s offices in California and Florida have gone unanswered. Verisign oversees the world wide web concerning .com, .net, and the structure of the internet itself.
