Illinois – www.napervillesun.suntimes.com – An out of court settlement could be in the offing in the ongoing saga of adult-film actress Jenna Jameson and the owner of two independent movie theaters in Naperville and Woodridge.
Associate DuPage County Circuit Court Judge Patrick J. Leston on Thursday vacated a default judgment he entered last week against Jameson. She is the defendant in a $50,000 breach of contract lawsuit filed by Ted E.C. Bulthaup III, the owner of Hollywood Palms Cinema in Naperville and Hollywood Boulevard Cinema in Woodridge.
Naperville attorney Paul D. Nordini, whose clients have included professional athletes and other celebrities, was recently recruited by Jameson to defend her in the litigation. Leston’s decision means Nordini and Jameson can proceed in the case.
Nordini said Thursday he and Bulthaup’s attorneys are “trying to somehow resolve the case” before it goes to trial.
In spite of that, Nordini said he has asked Leston to disqualify Bulthaup’s legal team because of their alleged attempts to “extort and blackmail” Jameson.
Nordini said one of Bulthaup’s lawyers in April sent Jameson an e-mail “that essentially said they are disinterested in following the terms” of her contract with Bulthaup’s theaters or rescheduling her personal appearances there. They warned that Jameson would be sued unless she paid them $50,000 by May 4, Nordini said.
“This was an attempt to extort and blackmail money from her,” Nordini said of his client. “Her position is that she was never in breach of an agreement, and was engaged in trying to reschedule” her appearances, he said.
Nordini added he has informed DuPage County State’s Attorney Bob Berlin and Illinois Attorney General Lisa Madigan of the alleged extortion attempt.
Bulthaup could not be reached Thursday at either of his theaters for comment on the day’s court proceedings.
His attorneys in May sued Jameson, whose legal name is Jenna M. Massoli. They accused her of failing to make paid appearances March 24-26 at Bulthaup’s theaters, opting instead to spend part of that weekend attending a birthday party in California for gossip maven Perez Hilton.
Both theaters had scheduled screenings of the 2008 camp film “Zombie Strippers!” in which Jameson starred, according to the lawsuit. Jameson was to autograph photographs of herself and 200 copies of her book, “How To Make Love Like A Porn Star,” and interact with fans and pose for photos with them, the suit declared.
Bulthaup’s company sold hundreds of advance tickets to the screenings; paid for travel and lodging for Jameson, her agent and personal assistant; and “invested thousands of dollars in advertising (and) dedicated hundreds of employee hours to making the weekend’s events a success,” the suit stated. Her appearances would have generated “tens of thousands of dollars in revenue” for the cinemas and Jameson, according to the litigation.
Jameson’s agent, shortly before their scheduled arrival in Chicago, sent “a vague doctor’s note” to Bulthaup, which maintained Jameson had had a “medical emergency” and would be unable to attend the screenings, the suit declared.
Photographs of Jameson attending Hilton’s party were later posted on his blog.
Leston has continued the matter to Aug. 15.
