British Columbia – from www.bclocalnews.com – A sex novelty shop that screens X-rated adult movies in North Surrey has been effectively terminated by the city.
Roxxxy’s, which opened up last November in the 10700 block of King George Boulevard, recently had its licence revoked by Surrey, which claimed it was issued in error.
Owner Tony Perry locked the doors and hired a lawyer.
After reviewing the case, Perry’s lawyer said his client would probably win the battle, but he’d ring up a huge bill in the process.
“The frustrating part was if they didn’t want me there, give me somewhere else to go,” Perry said.
In April, Surrey council passed a bylaw outlawing adult entertainment stores from locating anywhere in the city.
Until then, adult entertainment store or restricted theatre (theatre 2) zones were limited to the block where Perry’s store is located.
Perry said that pretty much shuts the door on Roxxxy’s in Surrey for good.
“I guess that’s the end of it,” Perry said. “I honestly don’t know where to go. I guess if they’ve done that, they’ve won.”
He’s surprised that the city has targeted him.
“I’m a little businessman trying to make a living doing a legal thing,” Perry said.
He acknowledges he could relocate to another city, but he expects he would end up in another scrap with the council there.
He’s been in the business since the 1950s, operating several adult sex stores, and said communities usually put up a bit of a fight when he sets up shop in their municipality.
“Not to the degree and persistence that went on here,” he said. “Mostly, if your lawyer talks to their lawyer and (says) ‘you can’t do this’ you come up with some kind of a compromise.”
He expects to sublet the space if he can.
The owner of the property will be redeveloping it for condominiums next year.
