Sewell, N.J. A Sewell couple claims in a lawsuit that a rented Blockbuster video, Home Alone 3, included hard-core pornography and was seen by their 4-year-old daughter.
The Superior Court suit filed this week against Texas-based Blockbuster Corp. says the firm “had a responsibility and a duty to inspect, monitor and ensure the quality and propriety of all video products purchased by its customers.”
A spokesman for Blockbuster said the company hasn’t seen the lawsuit but noted that its stores don’t carry adult or NC-17 movies or adult-rated games.
“Certainly we’re in a unique industry and we do allow our members to borrow our product and return it to us in the same condition it was given to them,” said company spokesman Randy Hargrove. “Unfortunately there are those rare instances when someone will abuse that privilege and damage one of our tapes.”
The plaintiffs say they rented the video cassette April 7 from a Blockbuster store on Route 47 in Glassboro.
The complaint prepared by attorney Daniel Zonies, states the family “has and will continue to incur costs to rectify the injury sustained by their daughter of tender age.”
Zonies said his clients were disturbed by the incident and concerned about renting anything else.
The attorney said for months, before filing the lawsuit, he sought information from Blockbuster’s legal department to determine who had the tape before the family.
Zonies said he has retained the cassette but has not viewed it.
A paralegal in his office who played the video said the pornographic material appears for 10 minutes after the credits for Home Alone 3.
