“Death Warrant”: Pure Platinum in San Diego Loses Its Liquor License

SAN DIEGO – from www.signonsandiego.com – Several employees at a San Diego strip club found themselves out of work Friday after an undercover operation into activities at the club resulted in the revocation of the business’ alcoholic beverage license.

The notice that the license was rescinded was posted on the doors of Pure Platinum on Pacific Highway south of Laurel Street at 10 a.m.

There are 34 separate violations listed in the state accusation against the business, including the allegation that on-duty employees sold or negotiated the sale of cocaine to undercover officers six times between October 2008 and January 2009, said John Carr, spokesman for the state Department of Alcoholic Beverage Control.

Of those violations at least 12 were lewd conduct violations, said ABC District Administrator Jennifer Hill. That can include anything from distance from a customer to attire, Hill said.

Ernie Encinas, a security consultant for the club, said the punishment was unfair and too harsh.

He said that a fine or a suspension would have been more appropriate.

“They are punishing a lot of innocent, hard working people who had nothing to do with the drug sales,” Encinas said.

He said that since 2009 the club spent thousands to upgrade security, install cameras and take other measures to ensure there was no more illegal activity on the premises.

Encinas estimated that 15 to 20 of the club’s 30-plus employees would have to be let go.

The order is effective immediately, Hill said. The license may be reapplied for after one year.

In the meantime, in an attempt to stay in business the club will go from topless to all-nude dancers, which is not allowed at establishments that serve alcohol.

He said it would be difficult to make up for the loss of revenue from alcohol sales and likened the ABC action to a “death warrant” for the business.

ABC officers conducted the undercover operation and were assisted by Harbor, San Diego, Chula Vista and University of California at San Diego police departments during the service of the search warrant in 2009.

The club was busy that night and extra officers were needed for the search and security, Hill said. In all, the operation resulted in at least four felony arrests, Hill said.

The revocation of an alcoholic beverage license is a lengthy and complex process that includes hearings and appeals and can sometimes go as far as the California Supreme Court. The business exhausted all of its legal avenues to appeal the revocation, Hill said.
