Defense Attorney: Evidence suspect in case against accused Ron Jeremy Nudie Photo arsonist

The attorney defending accused arsonist Andrew Scott Brus says she has several issues with the evidence investigators say connects her client to two fires at a south Bakersfield home in May.

The fires, which occurred just two days apart at the home at 2901 Dell Ave., were both followed by threatening letters and nude photos [including those taken with Ron Jeremy] of the female homeowner sent to the residence of her boyfriend’s mother and stepfather.

Brus, who was arrested in June on suspicion of attempted murder and two counts of arson, had a nine-year relationship with Crystal Leann Wooten, the owner of the burned home, according to investigation reports.

Bakersfield Fire Department investigators believe the 29-year-old Brus started the fires because Wooten began seeing another man, Brandon Scott Downs.

A story published in The Californian on Sunday contained numerous details from investigation reports — but nothing from the defense.

Brus’ attorney, Deputy Public Defender Nancy Sharp, said she wanted the chance to rebut the evidence.

Investigators contend that Brus sent the nude photos to Downs’ family. But investigators agree that the photos were shot by Downs using a cell phone owned by Downs.

Fire investigator Danny Brown was told by Wooten that the cell phone was lost or stolen at a beer festival — and that the phone must have ended up in the hands of Brus.

What are the chances of the lost cell phone being found by the ex-boyfriend at a crowded festival, Sharp asked.

And the handwritten notes delivered with the photos taken by Downs?

The notes were not written by her client, Sharp said. “The handwriting is not even close.”

Sharp said her client has had difficulty all of his life with writing and spelling.

“He can write,” she said. “But the people who wrote those notes are not at the same level.”

Sharp said Brus has “been cooperative from Day 1” with investigators and provided them with at least 10 examples of his handwriting for further analysis.

Wooten, who has since moved out of the area, told an investigator she ended the relationship because of Brus’ drug use.

Wooten told investigators Brus pointed a gun at her several times, though there appears to be no charges listed on the court Web site related to such incidents.

However, at some point Brus appears to have pointed a shotgun at Wooten’s new boyfriend, according to court documents. The charges were dismissed.

Brown is “doing everything he can to ignore the evidence,” Sharp said.

She gave the following examples:

• The vehicles found by investigators on surveillance video near the time of the fires are similar but do not match vehicles connected to Brus, she said. For example, Brus’ pickup has a white tool box, while the truck on the video has a chrome tool box.

• “At the time of the second fire, my client was at home with a new girlfriend,” Sharp said. “His mother’s car was parked behind his truck and she had to move it before he left for work that morning.

• Wooten’s boyfriend, Downs, claims to have been asleep in Wooten’s house just before the first fire, but phone records show that he was text messaging Wooten during the time he said he was sleeping.

Matthew Ninke, the prosecutor on the case, said he couldn’t comment on the evidence, but noted the investigation is continuing and further analysis of evidence is expected.

He suggested that anyone with knowledge of the fires that occurred May 28 and May 30 should call or come forward.

In the absence of new information, Ninke said he will continue to move forward with the evidence gathered by investigators. Meanwhile, Wooten has moved away since the fires, according to Downs’ mother.

Brus is scheduled to appear in court Nov. 5.
