TRAVERSE CITY, Michigan – A tanning salon’s former owner, as well as a convicted Peeping Tom, face a civil suit from a woman who says she was humiliated when a man videotaped her as she tanned.
The suit names Brocom Inc., the company that formerly owned the Beach Tanning Salon, and Charles Thomas Andersen. Andersen, 41, of Traverse City, was sentenced last year to 45 days in jail for window peeping after he was convicted of sneaking into the tanning salon to attempt to secretly videotape a woman.
The tanning salon’s current owner, Deb Brittingham, is not involved in the suit and has nothing to do with the allegations. The suit, filed by attorney Patrick Heintz, alleges that Andersen intentionally inflicted emotional distress and that the tanning salon operator failed to ensure a safe environment for its customers.
Heintz is seeking more than $25,000 in damages for the woman, who is named as Jane Doe in the suit. Bradley Wierda, attorney for Brocom, denied his clients are responsible for what happened to the woman.
Wierda filed a motion for summary disposition last week asking the court to throw out the case because it uses a fictitious name for the plaintiff, but he said if the case proceeds he is confident Michigan law does not allow one person to be held responsible for another person’s crime. Brittingham said she hired a larger staff to monitor all areas of the business.
