from www.suntimes.com – Adult-film star Jenna Jameson wants the lawsuit filed against her by a Naperville theater owner dropped like the scorned woman in a campy Hollywood thriller.

Jameson was sued earlier this year for failing to make promotional appearances at two Naperville theaters after allegedly agreeing to accept $10,000 to sign autographs and pose for pictures with fans there.

In a new legal filing, the star of the 2008 film “Zombie Strippers” asks that the lawsuit be dismissed, contending the contract she purportedly signed to make the promotional appearances last March isn’t valid.

Resembling the plot in a bad film, the contract is so vague that’s it not understandable — and that makes it unenforceable, said Naperville attorney Paul Nordini, who represents Jameson in the lawsuit.

For one thing, it appears that Jameson could be entitled to all of the money collected during her appearances, not just the $10,000 she allegedly was promised, Nordini said.

That interpretation of the contract means theater owner Ted Bulthaup didn’t suffer any financial losses by Jameson’s failure to appear at the promotional events, Nordini contended.

“They can’t assert damages because they wouldn’t have lost anything,” Nordini said. The suit also has other legal deficiencies that warrant dismissing it, Nordini said.

Bulthaup sued Jameson for $50,000, contending her abrupt decision not to appear at his theaters cost him money he spent promoting the event as well as ticket sales and other profits her appearance would have generated.

The lawsuit alleges Jameson — whose real name is Jenna Marie Massoli — claimed she didn’t make the appearances at the Hollywood Palms and Hollywood Boulevard cinemas because she fell ill, even though she was spotted partying that weekend with erstwhile celebrity Perez Hilton.

Bulthaup’s attorneys declined to comment on the request to dismiss the case.
