STURGIS, S.D. — from www.therepublic.com – The owner of an adult entertainment store in Sturgis is facing misdemeanor charges for allegedly violating a state law that limits where such businesses can be located.

Dick and Jane’s Naughty Spot owner David Eliason is due to enter pleas Aug. 25. Eliason tells the Rapid City Journal that he’ll keep his business open until he gets a court order to shut it down.

State law requires adult-oriented businesses to be at least a quarter mile from certain public areas. The Sturgis Community Center has a parking lot adjacent to the parking lot of Eliason’s store.

Eliason contends the law is vague. He already has gone to court once, unsuccessfully trying to get a federal judge to force the city to give him a permit for a different site.
