Illinois- from www.triblocal.com – A judge overseeing a civil suit filed by a local theater against an adult-film actress set a date Wednesday for a judgment by default in the matter.
Lawyers for Hollywood Palms Cinema LLC told DuPage County Judge Patrick Leston that, despite being personally served with the lawsuit May 24, Jenna Marie Massoli, the legal name of adult actress Jenna Jameson, has failed to respond to the lawsuit’s claim.
Leston set July 27 for a hearing on a default judgment, which cinema lawyers requested in order to present their damages. The suit claims that Massoli faked sickness in order to skip appearances at theaters in Naperville and Woodridge and instead attend the birthday party of celebrity blogger Perez Hilton in late March.
The suit claims hundreds of tickets were sold in advance, and the theaters stood to make “tens of thousands” from the event. Massoli was to receive a minimum $10,000 cut along with first-class airfare and hotel stays. A book signing also was scheduled, as was a screening of her 2008 film “Zombie Strippers!”
Ted Bulthaup, owner of Hollywood Palms in Naperville and Hollywood Blvd. in Woodridge, said Massoli provided a note from a doctor, but the theater was not able to determine its validity.
“The proof was by my estimation wholly insufficient,” Bulthaup said Wednesday.
Bulthaup said Massoli’s refusal to contact the theater after the event left him “no choice” but to pursue legal action. He said he has since heard from several of Massoli’s business associates, including a publicist and a Web-designer, but not from Massoli herself.
“What I really don’t like is the callous disregard she has for her own fans,” he said, adding the event had sold out at both locations for the March 24 through 26 events, and the theater was forced to issue refunds.
But Massoli’s publicist, Charles Figueroa, said Thursday that Massoli loves her fans, and was planning on attending the event until she was told by doctors not to fly to Chicago.
“She has nothing against Chicago, nothing against (Bulthaup), nothing against her fans,” he said, adding that a doctor’s note was provided and that Bulthaup refused to accept it.
He also acknowledged that Massoli attended the birthday party for Perez Hilton — the weekend of the planned events in Naperville — but only for a brief period.
“She went, stopped by, said hello and left,” he said.
Figueroa said he tried to work with Bulthaup to reschedule, but said that Bulthaup acted “unprofessionally” and made “inappropriate” remarks about Massoli, forcing him to cut off communication.
“He was making my work environment very difficult,” he said.
Currently, Figueroa said Massoli is conferring with her assistant and lawyers to determine the best course of action. He said Massoli is still willing to reschedule in lieu of further legal proceedings.
“I talked to (Massoli), she said she wants to resolve this in a nice, calm way,” he said. “She is very upset it even had to come to this.”
According to the suit, compensation is sought for “a result of breach, including, but not limited to: advertising costs; expenses paid for travel and/or accommodations; employee hours spent preparing for the events and lost profits from both the events.”
It also seeks compensation for money lost because films that would have been shown if Massoli had not scheduled an appearance were not “and damage to Hollywood (Palms Cinema’s) reputation among its customers and members of the press who showed up for the canceled events.”
