from www.wlsam.com – A man filed suit Thursday claiming that he suffered emotional distress after his girlfriend’s ex-husband threatened to post a secretly taped video of the couple having sex on Youtube.
Michael Mangini claims that he and his girlfriend Jackie Gianforte were secretly filmed having sex in his office by private investigator Kathleen Dinunno on the night of Aug. 4, 2010, according to a lawsuit filed in Cook County Circuit Court.
The office was locked and the window blinds were closed to secure the privacy of the couple, who were the only people present in the office, according to the suit. Dinunno made the video through a gap in the window blinds or a recording device inside the office, the suit claims.
Dinunno performed the surveillance at the request of Gianforte’s then husband Joseph Gianforte or his brother Samuel and gave one of them a copy of the video, according to the suit.
The suit claims that Mangini and his girlfriend began a romantic relationship after the Gianfortes had separated. A judgment for dissolution of marriage was entered on Oct. 8, 2010.
The Gianforte brothers began threatening Mangini and his girlfriend through emails and text messages that they would show the video to family and friends of Mangini, including his ex-wife, or post the video on Youtube, according to the suit. The Gianfortes, Mangini and his girlfriend grew up together and share an overlapping circle of friends, acquaintances and work colleagues.
The suit claims that the brothers have refused to give the original or any copies of the video to Mangini or his girlfriend.
Mangini has suffered extreme levels of stress and anxiety and has required medical treatment, according to the suit. He has experienced extreme sweats, quickened heart rate, icy chill and severe chest pain during a panic attack.
The suit claims that the actions of the brothers have threatened irreparable harm to his business and social relationships.
The five-count suit names the Gianforte brothers and Dinunno and claims intentional infliction of emotional distress, infliction of mental distress, conspiracy to commit trespass and intrusion upon seclusion.
The suit seeks unspecified damages, court costs, an injunction prohibiting the Gianforte brothers from disseminating the video, and the return of the original and any copies of the video.
