Detroit- A trial date will be set in the misdemeanor prostitution case against a 21-year-old woman accused of receiving money for sex from Tom Athans, husband of U.S. Sen. Debbie Stabenow, D-Mich.
Alycia Martin of Westland left the Troy courtroom in tears Tuesday shortly after 52-4 District Judge William Bolle denied a motion to dismiss the case.
Bolle ruled Troy police acted legally during a Feb. 26 prostitution sting when they searched Martin’s room at the Residence Inn and arrested her. In a police statement, Athans said he paid Martin $150 for oral sex.
Athans was expected to testify, but Bolle ruled it wasn’t relevant to a dismissal decision. Athans, 47, who was not charged in exchange for his assistance, could be called to testify at the trial.
Athans’ attorney, Todd Flood, declined to comment after the hearing. Martin’s attorney, Frank Cusumano Jr., contended her arrest and the search were illegal.
On Tuesday, two Residence Inn employees testified to evicting Martin after the sting. When the hearing began last week, three Troy police officers testified about their roles in the sting.
Stabenow and Athans married in 2003.
