RICHARDSON, Texas- A fight is underway in Richardson to keep a North Texas business from opening its doors. The shop sells sexually explicit materials to adults, and the city says that it is not following the rules.
The store is called Zone d’Erotica. The Richardson retail location is stocked with merchandise, but the store is not yet open for business. Inside the Plano location, you can find exotic clothing, lotions, adult novelties and sexually explicit DVDs.
The City of Richardson says that this store is a sexually-oriented business, and required to obtain a special permit before opening. That process requires a public hearing and the approval of the Richardson City Council.
The store’s parent company, Adjust Video Incorporated, disagrees, and has filed a lawsuit in Dallas Federal Court.
The city defines a sexually-oriented business as one that sells items intended to provide sexual stimulation or sexual gratification to a customer.
“Sexually oriented business means a sex parlor, nude studio, modeling studio, love parlor, adult bookstore, adult movie theatre, adult video arcade, adult video store, adult motel, or other commercial enterprise the primary business of which is the offering of a service or the selling, renting, or exhibiting of devices or any other items intended to provide sexual stimulation or sexual gratification to the customer.”
In the lawsuit, Adjust Video Incorporated claims that Richardson’s law is too vague, and is unconstitutional. They say that the company’s “stock-in-trade consists of sexually explicit material that is presumptively protected by the First and Fourteenth Amendments to the United States Constitution.” Adjust Video Incorporated also says that they “do not intend to operate a sexually oriented business.”
Pete Smith, the attorney that represents the City of Richardson, says the city will strenuously fight this lawsuit. “We will do everything in our power to enforce our regulations,” he said, “so as not to allow an adult oriented business” in the City of Richardson.
A federal court judge will ultimately decide.
