Want to get rid of kiddie porn? Make it a capital offense.
PIERRE, SD – from www.keloland.com – The South Dakota Supreme Court has overturned the 100-year prison sentence given to a Pierre man convicted of possessing child pornography.
The high court upheld Troy Bruce’s conviction on 55 counts of possessing child pornography for videos found on a DVD. But the justices say his sentence violates the constitutional ban on cruel and unusual punishment because it’s disproportionate to the crime.
The ruling sends the case back to a circuit judge, who will resentence Bruce after comparing his case to sentences imposed in similar cases.
The circuit judge sentenced Bruce to the maximum 10 years in prison on 10 counts, with the terms to be served one after another.
The Supreme Court says there is no evidence Bruce made or distributed pornography or had sexual contact with a child.
