Tarzana – from www.bhcourier.com – Lawyers for an insurance company want a judge to determine if their clients have a duty to pay for legal representation of the owners of a Tarzana bar where a 2009 dispute between two women led one to one suffering severe burns.
Mt. Vernon Fire Insurance Co. filed the lawsuit Tuesday in Los Angeles Superior Court against Babes & Beer, a bikini dancing and sports bar.
The suit is an outgrowth of a complaint filed against the bar in Van Nuys Superior Court by Babes & Beer dancer Roberta Busby of Simi Valley. She suffered second- and third-degree burns over 40 percent of her body after an argument with patron Rianne Theriault-Odom, 29, on Feb. 5, 2009, at the establishment in the 18000 block of Oxnard Street.
Theriault-Odom doused Busby with gasoline from a soda bottle and set her on fire, according to Busby’s lawsuit.
The first lawsuit ended in a settlement last month. Mt. Vernon Fire Insurance maintains its policy with Babes & Beer expired in October 2008, several months before the attack on Busby. They want a judge to affirm their claim that they have no obligation to the Babes & Beer owners.
In February, a panel of the 2nd District Court of Appeal upheld Theriault-Odom’s convictions for torture and aggravated mayhem. The 29-year-old woman is serving a life prison sentence.
Busby — who was 27 at the time of the attack — was hospitalized for five months, had 30 surgeries and suffered severe, disfiguring injuries.
