NY- A transsexual heiress ruined her chance of dodging jail by allegedly calling her mom, whom she was convicted of assaulting, and “barking like a dog,” officials said yesterday.
Diane Wells, 53, was sent to the slammer for 60 days after prosecutors received word of her alleged deranged dial ups. Assistant District Attorney Michael Kabakoff said he was prepared to asked for probation for Wells until the defendant’s brother complained of the bizarre phone calls.
Kabakoff accused Wells of calling her mother, Joyce Cheney, and her brother, James Cheney, 44, and “barking like a dog” and making other sounds into the telephone.
In addition to jail time, Wells will be on probation for three years. Justice Ellen Coin warned the buxom brunette that she’d spend more time in jail if she violated her probation.
Wells, who was born Jonathan Green Cheney, was convicted in April of reckless assault stemming from a May 2005 fight with her 84-year-old mother.
Prosecutors claimed the attack, which occurred in Constance Joyce Cheney’s $4 million Central Park West apartment, was prompted by the mother’s refusal to make Wells the sole beneficiary of her estate. Wells was accused of blowing cigarette smoke in her mother’s face and then wrenching the elderly millionairess’ arm so hard it broke.
Coin was unmoved by defense attorney John Sims’ argument that Wells should get a lighter sentence because she was acquitted of intentionally hurting her mother and had taken care of her for 17 years before the incident.
Sims suggested that the inappropriate calls Wells was accused of making could have come from James Cheney, who has been feuding with his sister over their mother’s estate.
Sims said the calls were not traceable to any telephone number and that James Cheney could take advantage of his sister’s incarceration to get an upper hand in a civil lawsuit they’re waging against each other.
