BRENTWOOD, New Hampshire — The man convicted and sentenced to 50 days in prison last year for using a digital phone camera to take pictures up women’s skirts in North Hampton and Newington is back in trouble.
Florentino Avila, 47, of Colorado, is accused of downloading photographs and video of child pornography on his home computer.
Avila was indicted by a Rockingham County Superior Court grand jury this week on five counts of child pornography. An indictment is not an indication of guilt or innocence; it means the grand jury found enough evidence to warrant a trial in the matter.
The new charge, which was brought forward by the Portsmouth Police Department, stems from Avila’s arrest on Aug. 3, 2005, on two charges of violation of privacy by taking pictures up two women’s skirts in North Hampton and Newington.
The Portsmouth Police Department arrested Avila at his place of work, Liberty Mutual in Portsmouth, on a warrant issued by the North Hampton and Newington police departments.
When Portsmouth police searched Avila’s apartment in the city, they said, they found the digital camera used to take pictures up the skirts of females, and they also found child pornography on his home computer.
Avila has pleaded guilty and served his sentence to the charges of taking the pictures up women’s skirts at the Irving convenience store in North Hampton and the Old Navy store in Newington. That sentence began Aug. 5, 2005.
While Avila admitted to taking other photographs in Portsmouth, the Portsmouth Police Department said there wasn’t enough evidence for that department to bring charges. But there was enough evidence to charge Avila with child pornography in Portsmouth, police officials said.
Possession of child pornography is a Class B felony, which carries a sentence of 3½ to seven years for each photograph or video image.
