The owners of three Virginia nightclubs are challenging state laws that prohibit stripping and topless dancing at clubs that serve mixed drinks.
A three-judge panel of the 4th U.S. Circuit Court of Appeals in Richmond heard arguments in the case Thursday. The court usually takes several weeks to rule.
The lawsuit was filed by three Papermoon nightclubs — two in Richmond and one in Springfield.
They claim there’s no legitimate rationale for state laws that allow striptease performances in establishments that serve only beer and wine, but prohibit them in clubs licensed to sell hard liquor.
The clubs are appealing a judge’s ruling upholding the constitutionality of the laws.
