You can talk about involved timelines, RPR levels, and 10-day waiting periods until you’re blue in the face. The question is did Mr. Marcus alter his test results? Marcus was tested positive for syphilis that we know, but the facts after that need clarification.

After reading the reports offered by both XBiz and AVN I see it going two different ways. The XBiz report tells us that during the first week of August Marcus returned to TTS.

“The production company for which he was scheduled to shoot required a new test from everyone. When he arrived, he was told by a clinician that ‘your numbers are still there.’

“The syphilis thing was still reading, and I looked at them and they looked concerned, and they said, ‘Maybe we can omit it from the actual test. When we submit your blood, we can just not have them test for that,’” Marcus claimed. “And I was like, ‘can you do that?’ [They said] ‘I think so.’

[This makes it sound like the TTS technician offered to doctor results for Marcus.]

“And so they sat down at the computer and started clicking on things. And I didn’t see what they were clicking on but I saw that they were clicking on something.”

Marcus, according to XBiz, alleged that a TTS clinician told him that the part of his test that shows “reactive or non-reactive” for syphilis could be removed from his test “because it’s always going to be there.”

“I get over there to pick up my test and they told me that the numbers were still there, and they gave me the printed copy of my test without the syphilis. It was omitted,” Marcus said.

[Marcus makes it sound like the technician was bent on doing him a favor out of the blue.]

Whereas the AVN story makes Marcus look like the culprit and instigator:

“It was at this point in the conversation that Mr. Marcus made the allegation that he asked a TTS employee to omit the syphilis portion of his test and print out a copy that would reflect that omission so he could present the doctored one to producers.

[The way I’m reading it, Marcus is asking them to make changes not someone at TTS volunteering.]

The story continues: “Marcus claims the employee was able to do so and provided him the print out, but he did not present this allegedly TTS-altered test to any producers, he said.

Marcus returned to TTS the first week of August in order to get a new test per the requirement of the producer he was scheduled to shoot for.

When he arrived, Marcus said the clinician at TTS told him “your numbers are still there,” meaning Marcus was still testing reactive to syphilis.

“I looked at them with a look of concern, but they said ‘Maybe we can omit it from the actual test. When we submit your blood, we can just not have them test for that,” Marcus claimed. “And I was like, ‘can you do that?’ They were like, ‘I think so.’

“So they sat down at the computer and started clicking on things. And I didn’t see what they were clicking on but I saw that they were clicking on something.”

Marcus stated that when he returned to the clinic to pick up his test on the way to the set “they told me the numbers were still there and they gave me the printed copy of my test without the syphilis [at the top where it would say ‘reactive.’] It was omitted.”

[The way the AVN story winds up reading, Marcus and the technician were complicit in altering results.]

Here’s where it matters most. In an interview she gave to The Daily Beast, Diane Duke denied that Mr. Marcus fabricated his tests: “There have been a lot of rumors…I would say the performer did not cheat the system. I would say other factors were at play,” she told them.

That statement makes it sound like Duke is laying blame at the feet of TTS and that’s the implication you draw from the XBiz account. It’s no secret that Duke and TTS are diametrically opposed on a lot of issues involving performer testing.

The AVN story, on the other hand, makes it sound like Mr. Marcus and TTS share 50-50 responsibility and if that’s the case Duke wasn’t forthright in her interview.

However Duke is also quoted by XBiz: “Yes definitely mistakes were made. And I know for me to say this out loud, this man took a lot of courage to come forward and do this. … It does take a lot of courage to come up and admit the mistakes that you made in manipulating a test.”

Duke is now admitting that Marcus did cheat the system.

Which is it? He did, or he didn’t?

I told you that Daily Beast article would come back and bite her in the ass.
