Czech court turns down Ukrainian porn star’s asylum effort

Prague – The Czech Supreme Administrative Court (NSS) has rejected the cassation complaint of Ukrainian porn star Anastasia Hagen-Hryshai who unsuccessfully applied for asylum for herself and her three sons, it ensues from the verdict published on the NSS’s website.

Hagen-Hryshai fears she would be jailed and her sons taken away from her if they returned to Ukraine, daily Lidove noviny (LN) writes yesterday.

On Monday, Hagen-Hryshai was reportedly given a 30-day exit visa in her passport.

“I expected it but the news still crushed me,” she told LN.

Now the only chance for her to stay in the Czech Republic is to lodge an application for a permanent residence permit along with a request for being enabled to wait for the decision in the Czech Republic, the daily writes.

The NSS said in its verdict that Hagen-Hryshai failed to prove a political character of her persecution. The file presents no other reason behind the criminal charges she faces in Ukraine than her starring in pornographic films.

“When assessing [her] first applications for international protection, [Czech] administrative courts based their decision on the fact that the complainants were not arrested in Ukraine, no wrongs were inflicted on them, they were not excessively harassed by the police and they were enabled to leave for the Czech Republic,” the NSS verdict said.

According to the ministry and the NSS, the launch of prosecution in a country where human rights protection does not reach western standards, is not alone a sufficient reason for granting asylum. Such “comfort” in asylum granting is unthinkable, the NSS said, upholding the previous position of the Interior Ministry.

Hagen-Hryshai left Ukraine for the Czech Republic two years ago in order to avoid prosecution for pornography. She applied for Czech asylum but the authorities rejected her request.

She made another try but the Czech Interior Ministry halted the proceedings and said she had to leave the Czech Republic.

Hagen-Hryshai then turned to courts, which finally upheld the ministry’s decision, LN writes.

Hagen-Hryshai’s husband is a Russian national and lives in Russia. She, however, would not like to reunite him in Russia, where, she says, the situation is similar to that in Ukraine. She is afraid that Ukraine would ask Russia for her extradition, LN writes.

Hagen-Hryshai gave up her job as a porn actress a few years ago, the paper adds.
