Colorado D.A. Says U. of Colorado Holds Recruitment Sex Parties

Denver- According to an article appearing in The Denver Post, The University of Colorado football team is using sex parties to entice recruits.
To make matters worse, the athletic department has resisted demands that the practice stop, according to Boulder District Attorney Mary Keenan

Keenan made the comments in a deposition taken in October. Keenan was deposed as a potential witness for Lisa Simpson, a former CU student who has sued the university over her alleged rape at a party attended by players and recruits in 2001.

The district attorney met with athletic department officials after Simpson reported being raped during a recruiting weekend in 1997. She put the department “on notice,” saying there was a problem with the football program, she said in the deposition which was obtained by the Post.

Keenan told the university officials that she thought women were being treated badly and that players and recruits were drinking too much, she said.

Keenan met with officials again after Simpson’s allegation surfaced, she said.

She does not believe the university has taken her complaints about recruiting weekends seriously, she said.

“They decided, after discussing the history, that they would not change anything because they could not afford to lose the competitive edge against universities such as Oklahoma (and) Nebraska,” Keenan said in her deposition.

Keenan was told this, she said, by a former CU athletic department official describing a meeting with athletic director Dick Tharp and football coach Gary Barnett.

Reached for comment, Barnett and Tharp denied Keenan’s assertion.

“That is absolutely a 100 percent out-and-out lie,” Barnett said. “I can’t fathom why anyone would imply that, say that, or make that up. It is a lie.”

Tharp said that neither he nor Barnett would ever “throw away all the values of our upbringing in exchange for a ‘W.”‘

All along, CU officials have denied there was anything other than consensual sex at the 2001 party.

In a September deposition, Barnett said he did resist one reform of the recruiting program: a curfew. “We were concerned that (a curfew) would create a recruiting disadvantage,” Barnett said in that deposition. “The jury is still out” as to whether the curfew was a good idea, he said.

In addition to the curfew, the only other change is that host players now are required to sign a pledge that they will follow university rules during recruiting weekends, Barnett said.

The Denver Post is printing Simpson’s name with her permission. Keenan never filed rape charges; she said she wasn’t sure she could prove them.

Another former student who said she was raped after the 2001 party, Monique Gillaspie, also has chosen to have her name released. A third woman who says she was raped at the party has asked that her name be protected.

All three have sued the university in federal court. Each is accusing the school of violating Title IX, a federal law against discriminatory policies in federally funded schools.

Keenan and other potential witnesses also have criticized Boulder police officer Don Spicely, who they say got players and coaches together before the official police investigation began.

Boulder Police Chief Mark Beckner on Wednesday said Spicely did nothing improper. Spicely was a liaison between the department and the football team, Beckner said.

Keenan said she found it “offensive” that football players have their own police liaison.

“It gave (coaches and players) a chance to cover it up,” she said. “How can Mark think that’s OK, that a group has a special liaison to warn them that something’s coming up so they can get their story together?”

Beckner said he was surprised by Keenan’s criticism. “That was all cleared up, as far as we were concerned,” he said. “If someone has specifics and wants to make an allegation, we’ll investigate it.”

Timothy Delaria, a CU police officer, said in a May 2003 deposition that there was a party the night before the party at Simpson’s off-campus apartment in Boulder.

Held at the Omni Interlocken Hotel, it was “some kind of sex party for the recruits,” Delaria said. He said recruits were shown a porn video and told that easy sex was a fringe benefit of being a Buffalo.

“They told us, you know, ‘This is what you get when you come to Colorado,”‘ a recruit told police, according to an interview transcript discussed in Delaria’s deposition.

In a hearing Tuesday in U.S. District Court, Magistrate Judge Craig Shaffer ordered Simpson’s lawyers to turn her complete diary over to university lawyers. He also ordered CU’s lawyers to prepare to release to the public depositions they had sought to keep sealed.

CU’s lawyers had argued that the depositions should remain sealed, to protect the identities of students. But Shaffer said he was not convinced that the students – and players in particular – had a right to privacy in this case.

Since players were given university funds to entertain recruits, they could be construed as being agents of the university, he said.
