Bahamas- A man who is supposed to be representing himself against porn importation charges, got off on the wrong foot on Friday in Magistrates’ Court when he showed up thinking he was going to trial instead of a mention.Dwight McDonald Lambert, 41, of Sound View Court, Sandys has pleaded not guilty to importing 22 pornographic DVDs between February 17 and May 9.
On Friday, Crown counsel Nicole Smith complained to Senior Magistrate Khamisi Tokunbo that Lambert had been making harassing telephone calls to witnesses. “The witnesses are upset by the number of times Mr. Lambert has called,” said Ms Smith.
But Lambert, who came to court armed with a large box of what was presumably case material, told the court he’d been making the telephone calls because he was confused about the date he was supposed to be in court.He thought he was appearing for trial, but it was only a mention.
“You are in a dubious situation,” said Senior Magistrate Khamisi Tokunbo. “Ordinarily, you would not be allowed to contact witnesses. Because you are representing yourself, there’s no reason you can’t contact them – but it can’t be perceived as badgering. But if they don’t want to speak to you they don’t have to.”
Lambert replied with surprise, “Oh really?”
Senior Magistrate Tokunbo urged Lambert to seek proper legal counsel, or brush up on his legal knowledge.
He set the matter down for mention on November 14, and a trial date was set for December 18.
